A Landmark Supreme Court Judgment Every Lift User Should Know

The Supreme Court of India has delivered a landmark judgment strengthening the rights of lift users and fixing responsibility for lift safety.

The Court has ruled that in the event of a lift accident, the lift manufacturer, maintenance agency, and building owner/management are jointly responsible for ensuring passenger safety. A lift has been treated as a "common carrier", requiring the highest standard of care.

A significant relief for victims is that they do not have to identify who was at fault before claiming compensation. They can recover compensation from any one of the responsible parties, who can later settle liability among themselves.

The judgment arose from the tragic death of former diplomat Vipin Handa in a lift accident at the R&AW headquarters in New Delhi. The Court found that repeated defects in the lift had not been addressed despite prior knowledge. Compensation of over ₹3 crore plus interest was upheld for the victim's family.

This ruling sends a clear message to housing societies, commercial buildings, hospitals and institutions:

Ensure regular preventive maintenance.

Act immediately on complaints of jerks, unusual noises or faulty doors.

Maintain inspection records.

Shut down unsafe lifts until repaired.

Train staff in safe rescue procedures.

For lift users, simple precautions such as avoiding overloading, reporting irregularities promptly and waiting for trained rescue personnel can help prevent accidents.

This judgment reinforces an important principle: passenger safety is a legal responsibility that cannot be compromised.
